Mediation

Mediation refers to a process for resolving disputes or conflicts relating to intellectual property rights. Mediation is an alternative dispute resolution method in which a neutral third party, the mediator, helps the parties to reach an agreement. The mediator supports the parties in clarifying their positions, clearing up misunderstandings and identifying common interests.

  • The aim of mediation is to find a solution that is acceptable to all parties without the need for court proceedings or arbitration. In the patent field, mediation can be used to settle patent infringement disputes or negotiate licence agreements. It is a flexible and confidential method of resolving conflicts efficiently and cost-effectively.
